These Terms and Conditions ("Terms") govern your access to and use of the website and application located at https://www.grantzap.com (the "Service"), operated by Flexology LLC DBA GrantZap ("Company," "we," "us," or "our").
By creating an account, making a purchase, or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1.1 Business Use: The Service is intended for business entities and professional use only.
1.2 Age: You must be at least 18 years of age and possess a valid credit card to use the Service.
1.3 Jurisdiction: This Service is intended for users located within the United States. We make no claims that the Service is appropriate for use outside of the U.S.
1.4 Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
2.1 Payments: All payments are processed through our third-party processor, Stripe. By providing payment information, you authorize us to charge the applicable fees.
2.2 No Refunds: Due to the digital nature of the content (immediate access to grant data and AI drafting tools), all sales are final. No refunds will be issued once the Service has been accessed.
2.3 Cancellations: You may cancel your subscription at any time via your account settings. Cancellation will stop future billing but does not result in a refund for the current period.
3.1 Nature of Service: GrantZap provides a database of grant opportunities and AI-powered tools to assist in drafting applications.
3.2 No Guarantee of Funding: GrantZap does not guarantee that you will be awarded any grant. The awarding of grants is solely at the discretion of the grant-providing organization.
3.3 AI Accuracy: You acknowledge that the "Auto-Drafting" features utilize Artificial Intelligence (AI). AI can produce inaccurate or "hallucinated" information. You are solely responsible for reviewing, verifying, and editing any content generated by the Service before submitting it to a third party.
3.4 Manual Submission: GrantZap does not submit applications on your behalf. You are responsible for the manual export and submission of your materials to grantors.
4.1 Implied Consent: By creating an account or making a purchase, you provide express consent for Flexology LLC (and its subsidiaries) to contact you via email, SMS, and/or phone for account updates and marketing offers related to other business software and services.
4.2 Opt-Out: You may opt-out of marketing emails via the "Unsubscribe" link. For SMS, you may opt-out at any time by texting "UNSUBSCRIBE" to 725-215-1131.
5.1 Referrals: Partners may earn commissions for successful referrals. We reserve the right to verify all referrals before payment.
5.2 Payouts: All commissions are paid via PayPal. You must provide valid PayPal information to receive payment.
5.3 Prohibited Conduct: Partners may not engage in "spamming," deceptive advertising, or any activity that violates the CAN-SPAM Act. Violation of these rules will result in immediate termination of the partner account and forfeiture of any pending commissions.
5.4 Data Transparency: Referrers will be able to see the name of the person they referred and whether that person made a purchase.
6.1 Our Content: The GrantZap database, software, logic, and "Smart Matching" algorithms are the exclusive property of Flexology LLC.
6.2 Your Content: You retain ownership of the specific business data you input. You grant us a limited license to process this data solely to provide the Service to you.
To the maximum extent permitted by law, Flexology LLC shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Service, including but not limited to the failure to secure grant funding or inaccuracies in AI-generated text.
These Terms are governed by the laws of the State of Nevada, without regard to its conflict of law principles. Any legal action related to these Terms shall be brought in the courts located in Clark County, Nevada.
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or a notice within the application. Continued use of the Service after such changes constitutes acceptance of the new Terms.
